Latest Update
Since the wrongful conviction of Doug Porter several issues have come up which delayed his sentencing. Evidence surfaced that jury members were influenced by media coverage during the trial. In response to testimony on this issue, a motion for a new trial was made by Defense Attorney Kirk McAllister. This motion was denied by Judge Thomas Zeff.
A second motion for a new trial was made when the deputy coroner involved in the case stepped forward and testified that the District Attorney's office suppressed his testimony. The coroner signed a sworn affidavit explaining that as the D.A. interviewed him in reference to this case; it became apparent that the findings corroborated Doug’s testimony. The coroner’s testimony took a shocking turn as he went on to explain that during the interview with the District Attorney’s office, he was stopped mid-sentence and told to “stop right there” claiming that if any more was said it would have to be “discovered” and he did not want to add such information to his report. In an interesting turn of events, the coroner’s testimony was left out of the trial completely and he was never called as a witness. The district attorney’s office instead opted to solicit the testimony of a coroner, who was not involved with the accident, but had merely read the report and interpreted the second hand information. The new trial motion based on this information was also denied by Judge Zeff.
Doug Porter was officially sentenced on December 12th, 2008.
